EMPLOYERS in Central Visayas may now start applying for exemption from the newly approved minimum wage hike.
The Department of Labor and Employment (Dole) opened the application for exemption through the Regional Tripartite Wages and Productivity Board (RTWPB).
In guidelines provided to the media by Dole Central Visayas, the agency explained that establishments unable to immediately comply with the new wage rates under Wage Order No. ROVII-26 may apply for exemption, subject to specific qualifications and documentary requirements.
The wage order, which took effect on October 4, 2025, increased the regionโs minimum daily pay after consultations held in Cebu, Bohol, and Negros Oriental.
While the increase aims to help workers cope with rising costs, the department acknowledged that some small and disaster-affected establishments may struggle to meet the higher pay rates.
The exemption serves as temporary relief for those employers while ensuring that labor standards remain observed.
Under the guidelines, businesses may qualify for exemption if they fall under small retail or service establishments employing not more than ten workers, or if they have suffered significant losses due to natural calamities or human-induced disasters.
Employers must submit a verified application and an affidavit of undertaking signed by the owner or authorized representative, declaring compliance with the previous wage order and notice to employees about the exemption request.
For calamity-affected establishments, the affidavit should also detail the amount of losses or damages, list of destroyed properties, and photos of affected sites.
A certified true copy of the current business permit issued by the local government is likewise required.
The RTWPB accepts applications filed in person, by mail, or through its official email, with the mailing date considered as the filing date.
All applications must be submitted within 75 days from the publication of the wage order or from the declaration of calamity, whichever applies.
Workers or unions may oppose the application within 15 days after receiving notice.
If approved, the establishment will enjoy a one-year exemption from compliance with the wage orderโs effectivity date, provided that it meets all the conditions set by the Board.(MyTVCebu)
