MORE charges will be filed against the 15-year-old student involved in the fatal shooting incident in San Jose National High School in Tacloban City last June 22,

Department of Justice (DOJ) Undersecretary Ian Norman Dato said the student “acted with discernment” during the incident.

With this, Tacloban City prosecutors ordered the filing of frustrated murder and attempted murder charges against the student, a report by Inquirer.net said.

The boy is one of the two Grade 9 students tagged as the shooters in the attack that left three fellow students dead and 20 others wounded 20.

The additional charges are separate from the three counts of murder and two counts of attempted murder that were earlier filed against the student before family court of the Tacloban Regional Trial Court.

“Our prosecutors found that he acted with discernment and in conspiracy with a second minor,” Dato said in a press briefing.

Under the amended Juvenile Justice and Welfare Act, the other minor, 14, involved in the attack is considered exempt from criminal liability.(MyTVCebu)
